Defendant appeals after a jury trial from a conviction for manslaughter in the first degree and a prison sentence of two and a-half to five years. Defendant had been indicted for murder in the second degree, but under a proper charge the jury returned a verdict only for the lesser crime of manslaughter in the first degree.
