The defendant, Wayne Garoutte, was charged by direct information in the Superior Court of Maricopa County, Arizona, with the crime of manslaughter in the driving of a motor vehicle, a misdemeanor under A.R.S. § 13-456, subd. A (3) (b) as amended laws 1957, said crime happening on or about May 21, 1961. The defendant filed a motion to dismiss on the basis of A.R.S. § 13-15911 which was granted.
