This is an action, ex delicto, by plaintiff, King Surry, and his common law wife, Katie Clark, for the recovery of damages for personal injuries and loss of property. It was consolidated for purposes of trial and appeal with another suit for damages by the owners of a house, rented and occupied by these plaintiffs.
