PARKER, Justice.

This is the second appeal in this case. In the first trial of this case in the superior court of Robeson County, at the August Civil Term 1962, a judgment was entered sustaining a demurrer to the amended complaint. We reversed the judgment sustaining the demurrer. McCallum v. Old Republic Life Insurance Co., 259 N.C. 573, 131 S.E.2d 435.
