We deal here with a written motion to dismiss upon the ground that the "court is without jurisdiction over the person of this defendant" which was sustained. There is no question but that the trial court has jurisdiction of the subject matter. Consequently, unless the petition shows on its face that the court has no "jurisdiction of the person," i.e., that the venue is improperly laid, the sustaining of the motion to dismiss was error.
