Roger Albertus Lutz, Jr., hereinafter referred to as defendant, was convicted in the Traffic Court of the City of Richmond on a warrant charging him with the violation of a city ordinance which prohibits any person from operating a motor vehicle while under the influence of intoxicants or drugs. § 22-98, Richmond City Code of 19571, as amended. He appealed the conviction to the Hustings Court of the City of Richmond...
