This is an action instituted by Carl H. Loewer against Frank J. Duplechin, d/b/a Duplechin Bonded Warehouse, and the New Amsterdam Casualty Company, surety on Duplechin's warehouseman's bond, for a sum of money alleged to be due plaintiff as the purchase price of rice which plaintiff had delivered to defendant's warehouse and which thereafter was allegedly sold.
