The parties to this case were formerly husband and wife. The plaintiff, Louise Stanton Van Nortwick, obtained a divorce from the defendant in March of 1956, on grounds of desertion. A negotiated settlement agreement was incorporated into the decree. This agreement provided that the plaintiff would have the custody of the two minor sons of the parties, Thomas and William.
