This is a certiorari action challenging the decision of a Judge in the Lee County District Court as to its denial of a writ of habeas corpus.

I. Petitioner was tried and convicted by a jury in Polk County of the crime of sodomy and on April 30th, 1957, was sentenced to a term of ten years in the Iowa State Penitentiary.
