The defendant, Nathan Zuckerman, was jointly indicted with Richard Cummings and charged with the offense of theft on two counts. The defendant changed his plea from not guilty to guilty and was admitted to probation. Subsequently the trial judge learned that the presentence investigation report which he had considered when he granted probation was incorrect.
