This case comes to us as a result of the granting of a petition for rehearing on behalf of the appellant, Pitts. The original decision was handed down December 6, 1962, and appears in 186 N.E.2d 800.

The petition for rehearing merely restates the same propositions as were presented to the Court in the appellant's, Pitts, original brief.
