This is an appeal on questions of law from a judgment of the Probate Court of Paulding County in a declaratory judgment action.

George C. Walters died testate providing in his will that his net estate should be divided equally between the plaintiffs and the defendant Church of God of Payne, Ohio, and he then provided:

"Item IV. I am especially making this will for the purpose of making the bequests and devises as hereinbefore set forth...
