Claimant seeks review of the final decision of the Secretary which denied to the claimant the establishment of a period of disability under 42 U.S.C.A. § 416 (i) and disability insurance benefits under § 423.

Claimant's action rests on 42 U.S.C.A. § 405(g), which states:

"The court shall have power to enter, upon the pleadings and transcript of the record, a judgment affirming...
