Plaintiff brought this action to recover the avails of an insurance policy upon the life of her deceased husband. In its answer the defendant admitted that it had issued a policy of insurance upon the life of the deceased but alleged that the policy had been issued in reliance upon false representations and warranties made by the deceased and asked that plaintiff's complaint be dismissed.
