The question before the court en banc in the instant action is the proper disposition of a rule granted upon Alvin Ackerman, plaintiff, to show cause why the judgment entered against Marwood Corporation should not be stricken from the record, and said Marwood Corporation be permitted to file an answer to the amended complaint filed by plaintiff.
