This case has been tried twice in the Superior Court. At the conclusion of the evidence in the first case the defendant made a motion for a directed verdict which was denied by the presiding justice. The jury returned a verdict for the plaintiff in the sum of $9,000.00. The defendant seasonably filed a motion for judgment n. o. v., or, in the alternative a motion for a new trial.
