Plaintiffs, Curtis and Helen Brown, sought to build a home in Helena. On September 10, 1958, they entered into a construction loan agreement with the defendant, First Federal Savings and Loan Association of Great Falls. The parties to this agreement were the plaintiffs (owners), one Tom Seely (contractor), and the defendant (Savings and Loan Association).

Plaintiffs and Seely agreed on a home to be built for about $17,500...
