The offense is assault with intent to murder with malice; the punishment, confinement in the state penitentiary for ten years.

The state's evidence reflects that in the early morning hours of May 22, 1962, appellant's car made an improper turn from the wrong lane and struck a car driven by Ted M. Akin.
