This is an appeal from a conviction in a criminal case. The defendant was charged in one Count which reads:

"That on or about the 21st day of August, 1962, in the City of St. Louis, in the State of Missouri, within the Eastern Division of the Eastern District of Missouri, James Bass did unlawfully acquire from a person whose name is to the Grand Jury unknown a certain quantity of marihuana...
