This suit was brought by appellee, H. T. Taylor, Sr. to establish and confirm his ownership of 1200 shares of the capital stock of Banks Transportation Co., which had been pleadged by Louis Banks, Jr., to secure the payment of his two promissory notes dated December 17, 1959, such stock having been bought by appellee at private sale on April 4, 1963 upon default in the payment of said notes.
