Defendant was found guilty by a jury of first degree robbery by means of a dangerous and deadly weapon; upon a finding by the Court of five prior felony convictions he was sentenced to a term of forty years' imprisonment, after the Court had first considered and overruled a rather exhaustive motion for a new trial.
