Plaintiff in error, Sam Hawkins, herein referred to as the defendant, was convicted of an assault with an intent to commit voluntary manslaughter (T.C.A. § 39-603) and of the additional offense of carrying a pistol with an intent to go armed (T.C.A. § 39-4901). For his first conviction he was sentenced to 11 months and 29 days in the Shelby County workhouse, and for the second, to six months in the same institution and a fine of $50.00. The...
