FELTS, Justice.

Plaintiff in error, Willie Roy Batchelor, hereinafter called the defendant, was indicted and tried along with two other men for receiving, possessing, and transporting more than one gallon of liquor. A jury found the two other men not guilty and acquitted them; and they are not involved in this appeal. Defendant was found guilty and sentenced to serve one year and one day in the penitentiary (T.C.A. § 39-2509), and judgment was entered accordingly...
