Leatherwood Drilling Company, hereinafter referred to as Leatherwood, sued TXL Oil Corporation, hereinafter referred to as TXL, for the sum of $52,620 for damage to a drilling rig resulting from an oil well fire. The petition recited that Firemen's Fund Insurance Company had paid to Leatherwood the sum of $52,620 as insurance covering Leatherwood's loss, that the insurance company was the real party in interest and had been authorized in writing...
