PER CURIAM.

Defendant was indicted for the crime of Embezzlement by Agent as defined by section 710.5, Code 1962, I.C.A. He entered a plea of not guilty, was tried before court and jury, found guilty and, pursuant to Code sections 709.2 and 710.5, sentenced to a term of a year in the county jail. Three months of the sentence were suspended and a bench parole granted him during defendant's good behavior.
