The State Road Commission of West Virginia, a corporation, hereinafter referred to as "state", instituted this proceeding in eminent domain in the Circuit Court of Wayne County seeking to condemn for highway purposes a parcel of land containing 1.459 acres, more or less, belonging to Byron and Ethel Ferguson, hereinafter called "landowners".
