Hattie Loat, on July 13, 1959, was a passenger in a motor vehicle being driven by her husband. As a result of a collision with another motor vehicle, both Mr. and Mrs. Loat were killed. The administrator of the estate of Mrs. Loat instituted a personal injury action in the court below seeking damages against the estate of her late husband. The causes of action were asserted under the Wrongful Death Statute of this State (10 Del.C. § 3704...
