Hattie Loat, on July 13, 1959, was a passenger in a motor vehicle being driven by her husband. As a result of a collision with another motor vehicle, both Mr. and Mrs. Loat were killed. The administrator of the estate of Mrs. Loat instituted a personal injury action in the court below seeking damages against the estate of her late husband.
