Plaintiff, as administrator of the estate of Harry Ellis, Sr., deceased, originally filed this suit for workmen's compensation benefits and alternatively in tort for damages arising out of fatal injuries to Harry Ellis, Sr. while unloading his log truck at defendant's lumber mill.
