Appellant, petitioner, a prisoner in the penitentiary, appeals to us from the denial of his petition for Writ of Habeas Corpus by the district court.

By county attorney's information appellant was charged with the offense of uttering a false instrument. (Section 718.2 Code of Iowa, I.C.A.) He was arraigned.
