AUFLICK v. STATE

No. 4255.

158 So.2d 767 (1963)

Thomas J. AUFLICK, Appellant, v. The STATE of Florida, Appellee.

District Court of Appeal of Florida. Second District.

Certiorari Denied January 6, 1964.

Attorney(s) appearing for the Case

Marcus A. Wilkinson, III, Asst. Public Defender, Tampa, for appellant.

Richard W. Ervin, Atty. Gen., Tallahassee, and Robert R. Crittenden, Asst. Atty. Gen., Lakeland, for appellee.

PER CURIAM.

The appellant, seeking post conviction relief under Criminal Procedure Rule No. 1, F.S.A. ch. 924 App., failed to allege that he was insolvent and unable to obtain counsel at the time he entered his plea.
