This is an appeal from the district court's dismissal of four of five diversity causes of action asserted against two Minnesota villages operating municipal liquor stores. The suits are based upon the state's Civil Damage (or "Dram Shop") Act, Minn.Stat.Ann. § 340.95.1 The problem presented is evidently one of first impression.
