Although the prosecution of the action has been unduly delayed, the reasons for the delay have been accepted by the Special Term as sufficient; and we decline to interfere on this record with the basic discretion there exercised. The delay is attributed to the misplacement of the file in the law office of an attorney retained as trial counsel; and there is no suggestion in any of defendant's papers that this did not in fact occur and helped to contribute to plaintiff's delay...
