In this condemnation case the commissioners appointed by the circuit court awarded defendants the sum of $47,500 for the taking of their 68-acre farm and both plaintiff and defendants filed exceptions to that award. In the subsequent jury trial a verdict was returned for defendants in the sum of $42,000. Thereafter, the trial court sustained defendants' motion for a new trial upon the sole ground that the court had erred in giving Instruction...
