This action was begun in the Superior Court of Seminole County, Oklahoma, by defendant in error, Dick Bell, hereinafter referred to as plaintiff. The defendants were the directors and cashier of the defunct Bank of Earlsboro. The petition sought recovery from the defendants for deposit of plaintiff in the sum of $28,353.20 lost through the alleged misconduct of defendants as hereinafter set out.
