In this case error is assigned on the order of the trial court granting the defendant's motion for summary judgment. "The purpose of the Summary Judgment Act of 1959 is to eliminate the necessity for a jury trial where there is no genuine issue as to any material fact and the moving party is entitled to a judgment as a matter of law.
