The appeal is from a conviction for rape, with the infliction of the death penalty.

The date of the alleged crime was fixed at August 1, 1961. Appellant, Frank Lee Rudolph, was indicted by a grand jury of Jefferson County on September 1, 1961, and was arraigned on October 20, 1961.
