On October 13, 1961, petitioner, represented by counsel of his own choosing, after electing a court trial, was tried by the Circuit Court for Queen Anne's County and found guilty of unlawfully breaking and stealing goods of the value of $5.00. On the same day petitioner was sentenced to the Maryland Penitentiary for the period of four years, commencing May 12, 1961.
