This is the second time that a phase of this family controversy has come before us for review. The litigation began in December, 1956, following the death of Jennie Berkowitz, mother of the contending parties, in April of that year. The complaint as originally framed sought to set aside conveyances of real estate allegedly procured by undue influence exerted on the deceased.
