Appellant was indicted for the first degree murder of his wife and after a trial by jury was convicted of murder in the second degree. He was sentenced to the Indiana State Prison for life and he appeals from the judgment.

Appellant first contends the verdict is not sustained by sufficient evidence. The evidence favorable to appellee is as follows:
