This matter came before us on an appeal from a summary conviction before a magistrate. Defendant was charged with violation of section 401 of the Milk Control Law of April 28, 1937, P. L. 417, as amended July 24, 1941, P. L. 443, 31 PS § 700j-401, providing as follows:
