Charles Merkle commenced a proceeding against Horace J. Yarbrough alleging two causes of action. In the first cause plaintiff alleged that defendant had unlawfully taken possession of certain cattle belonging to plaintiff and caused them to be sold at public auction; that plaintiff was entitled to damages for the reasonable market value of the cattle at the time of the conversion and sale.
