JORDAN, Judge.

This was a suit by the plaintiff to recover damages for personal injuries sustained by him when he was struck by an automobile operated by the defendant as the plaintiff was attempting to walk across Nicholls Street in the City of Waycross, shortly before dawn on the morning of January 16, 1962. The jury returned a verdict for the plaintiff, and the trial court denied the defendant's motion for a new trial. The exception is to that judgment.
