This is an action of contract by the beneficiary of a savings bank life insurance policy issued by the defendant. The case was heard upon a stipulation as to all the facts by a District Court judge, who found for the plaintiff. The Appellate Division vacated that finding and ordered a new finding to be entered for the defendant. The plaintiff appealed.
