Jim Owen Vanderburg appeals from a judgment of conviction entered after a verdict of guilty; the information charged that:

"The said Jim Owen Vanderburg on or about the 21st day of April... nineteen hundred and sixty-two, ... did wilfully, unlawfully and feloniously have in his possession and under his custody and control a certain firearm, to wit, a German P-38 automatic pistol, capable of being concealed upon the person, the said Jim Owen Vanderburg...
