This is an appeal from a summary judgment (LSA-C.C.P. Art. 966) dismissing a wife's suit to recover death benefits for herself and her three minor children under the provisions of the Louisiana Workmen's Compensation Act.

Plaintiff's pleadings and her deposition taken under oath in the presence of her attorney show affirmatively that neither she nor any of the children had resided with the decedent for at least five years prior to his death; and...
