Vernon Early appeals from a conviction of second degree burglary in the Circuit Court of Perry County. He was tried under an indictment containing two counts for first degree burglary of the home of Rebecca Williams.

The State's evidence tended to show that on September 22, 1962, at between 8:00 and 8:30 P.M., Rebecca Williams, a Negress, and her sixteen year old daughter, Gladys, had prepared to retire for the night and that Rebecca was attired...
