This is a law action. Defendant filed a motion to dismiss Plaintiff's petition, contending that the alleged cause of action was barred by the Statute of Limitations, Section 614.1(9) of the Code, I.C.A. The trial court overruled the motion. Right to appeal was granted as authorized by Rule 332, R. C.P., Code of Iowa, 58 I.C.A.
