This is a declaratory judgment action instituted by the plaintiff, Calmar, Incorporated, against the defendant Cook Chemical Company, asking this court to declare that U. S. Patent No. 2,870,943 issued to Baxter I. Scoggin, Jr., on January 27, 1959, and presently owned by defendant Cook Chemical Company is invalid and not infringed by plaintiffs.
