KING, J.

The defendant was indicted, in two counts, on a charge of murder in the first degree in the killing of Francis Gavell, manager of the First National store in New Milford, on November 18, 1959. The first count charged wilful, deliberate and premeditated murder, and the second count charged murder in the perpetration of a robbery. On May 24, 1960, after a trial to the jury, the defendant was found guilty on both counts, the jury made a recommendation for clemency...
