Defendant was charged and convicted of robbery in the first degree under the Habitual Criminal Act. See Secs. 560.120 and 556.280 RSMo 1959, V.A.M.S. Three prior felony convictions were alleged and shown to the court. The jury found defendant guilty of the offense charged and the court, finding that defendant had previously been convicted of a felony, assessed his punishment at ten years' imprisonment in the state penitentiary.
